Terms of Use
Effective Date: June 3rd, 2023

By accessing the Canadian Mail Master website and using the services provided by Canadian Mail Master, a division of Canadian Mail Master, you agree to be legally bound by the following terms and conditions. These terms apply to all current and future features offered by the service, collectively referred to as the "Service."

If you accept these terms on behalf of a business entity or third party, you confirm that you have the legal authority to bind such entity and its affiliates, along with all individuals accessing the Service through your account, to these terms. Without this authority, you may not use the Service.

#Service Eligibility
The Service is available solely to individuals who are at least 16 years old. Accounts must be registered manually and not through automated methods. Responsibility for all content transmitted through the Service lies with the user.

#Acceptable Use
You commit to not using the Service for any illegal or unauthorized purpose. Additionally, you will not disrupt the network and server infrastructure of the Company.

"Spam" refers to unsolicited, often repetitive messages sent over the Internet, typically for advertising purposes. You agree not to use the Service to transmit Spam, engage in phishing, spread malware, or violate our mailing list policies, including sending to recipients who have not consented to be included.

Violations involving inappropriate use, such as sending or storing prohibited content, will result in immediate account suspension.

The creation of multiple free accounts by a single individual or entity for abusive purposes, including bulk registrations, is not permitted. Free accounts are intended for the personal use of the registrant only. The Company reserves the right to take action against any account deemed to be in violation.

The sale or transfer of Canadian Mail Master accounts to another party is strictly prohibited. Accounts used for illegal activities will be terminated, especially in response to legal orders from competent authorities.

The Company is under no obligation to retain or forward the contents of terminated accounts.

While currently not practiced, the Company reserves the right to suspend or delete accounts inactive for over a year. This does not apply to accounts with an active paid status.

#Warranties and Liability Limitations
The Company makes no warranties regarding the reliability or security of the Service and will not be held liable for any data loss, damage, or lost profits resulting from its use or performance failures.

You also waive any right to hold the Company responsible for any unintentional disclosure of confidential information due to security breaches.

We reserve the right to modify the Service without prior notice.

#Service Level Agreement (SLA) for Paid Users
The Company targets a 99% Service availability. If downtime exceeds 1% in a month, users may request service credits towards their next billing cycle.

Service credits are calculated as follows:

- 10% of the monthly cost for uptime below 99% but above or equal to 95%.
- 30% of the monthly cost for uptime below 95%.

Exclusions from downtime calculations include:

- External factors beyond the Company's control.
- User or third-party actions or inactions.
- User or third-party equipment issues.
- Suspension or termination of Service access as per these terms.
- Scheduled maintenance announced in advance.

#Indemnification
You agree to indemnify the Company, its affiliates, officers, employees, and third-party contractors against any claims or damages arising from your use of the Service.

#Privacy
Your use of the Service signifies your agreement to our Privacy Policy, which outlines our data handling practices.

For services involving the processing of personal data subject to the EU GDPR, the Canadian Mail Master Data Processing Agreement applies.

#Payment Terms
Paid services are generally non-refundable, except at the Company's discretion. Accounts terminated for terms violations are not eligible for refunds.

Refunds will be issued in the original currency and method of payment. The Company reserves the right to suspend services for fraudulent payments and may refer such cases to law enforcement.

Payment for services is on a recurring basis, and it is your responsibility to keep payment information current.

Accounts in default may be suspended or deleted.

Disputes resulting in charges beyond the service cost authorize the Company to recover these from your account.

#Modifications to Terms
The Company may revise these terms, and continued use of the Service after changes indicates your acceptance of the new terms.

#Governing Law
These terms, and any disputes arising from the use of the Service, are governed by the laws of United Kingdom, with jurisdiction for disputes residing exclusively in United Kingdom courts. The United Nations Convention of Contracts for the International Sale of Goods is excluded.

Disputes are to be resolved on an individual basis, with no class or consolidated actions permitted.
